ORDER :
In the reference 1st read above, the National Council for Teacher Education (Southern Regional Committee), Bengaluru, granted recognition to Ayesha College of Education, Mallaram Village and City, Varni Road, Nizamabad Taluk & District for conducting B.Ed Course of Two years duration, with an annual intake of 100 students (2 units), from the Academic Year, 2017-2018, subject to the fulfillment of  certain conditions.

2.    In the reference 2nd read above, Secretary, Ayesha Educational Society, Nizamabad, Telangana, dtd:01.10.2017 requested to  allow them to start a new  B.Ed college Ayesha College of Education, Mallaram Village and City, Varni Road, Nizamabad Taluk & District for Two years B.Ed., Course,  with an annual intake of 100 students (2 units),  from the Academic Year, 2017-2018.

3. In the reference 4th read above, the Hon’ble High Court allowed the W.P.No.33192/2017, filed by Ayesha College of Education, Mallaram Village and City, Varni Road, Nizamabad Taluk & District on 04.10.2017, with a direction to consider the case of the petitioner in terms of para (20) of the judgment of the learned Single Judge in Writ Petition No.26870/2016 and batch, dt:16.09.2016, for the Academic Year, 2017-18.  

4. In the reference 5th read above, the Commissioner and Director of School Education, Telangana, Hyderabad, gave a report that four faculty members are duplicated in other colleges and they are (1) Syed Aslam, Lecturer in Pedagogy of Physical Science is working as Lecturer in Science at Panchsheel Institute of Education, Nirmal, Adilabad District (2) A.Narendar, Lecturer in Pedagogy of Social Sciences is working as Lecturer in Social Studies at St.Thomas Institution of Elementary Teacher Education, Achanpally (V), Bodhan (T), Nizamabad District.(3) Aruna S.Lecturer in Pedagogy of Telugu is working as Lecturer in Telugu at St.Thomas Institution of Elementary Teacher Education, Achanpally (V), Bodhan (T), Nizamabad District. (4) Mukka Vidyasagar, Lecturer in performing Arts is working as Lecturer in Fine Arts at St.Thomas Institution of Elementary Teacher Education, Achanpally (V), Bodhan (T), Nizamabad District. Moreover only one faculty member has 3 years teaching experience which is not sufficient as per the NCTE norms.

In the reference 6th read above, the Government informed Regional Director, National Council for Teacher Education(NCTE), Southern Regional Committee (SRC), Bengaluru, regarding the deficiencies in respect of Ayesha  College of Education   as mentioned in Para 4 above, with a request to withdraw the recognition given to Ayesha  College of Education , Nizamabad District  as per the NCTE norms that “If the institution contravenes any of the above conditions or the provisions of the NCTE Act, Rules, Regulations and orders made of issued there under, the institution will render itself vulnerable to adverse action including withdrawal of recognition by the regional committee under the provisions of Section 17(1) of the NCTE Act.” This was also done in pursuance of the Hon’ble High Court observations in the orders dtd.06.01.2017 in Writ Appeal No.1047/2016 and batch that “Even if the State intends to express any grievance as to non-compliance of any one of the conditions required under the Norms, the State ought to have brought the same to the notice of the NCTE and ought to have sought appropriate action against the society/college, which the State has not resorted to.”
  
6. In the reference 7th read above, the Regional Director, NCTE, SRC, Bengaluru, informed that on the deficiencies pointed out by the Government, NCTE has issued a Show-Cause Notice dtd.28.11.2017 to the Institution viz., Ayesha College of Education, Nizamabad District for a reply. 

7. In the reference 8th read above, a Show Cause Notice dtd.13.04.2018  in C.C.No.874/2018  was received by the  Government  from the Hon’ble High Court to file Counter Affidavit by 08.06.2018. A detailed Counter Affidavit was filed in the C.C No.874/2018 by the State Government on 07.06.2018.

8. In the reference 9th read above, by order dtd.15.06.2018 in CC No.874 of 2018, the Hon’ble High Court directed for personal appearance of the Government  represented by the Spl. C.S. to Government Education on 28.06.2018 and mentioned that however, if the Government complies the orders of this Court, as is done in the other case similarly situated, the Government represented by the Spl. C.S. to Government Education need not be present before the Court and it could be suffice if an affidavit is filed before the Court reporting compliance of the orders of this Court. 

9. Hence, after careful examination of the matter and in pursuance of the orders of the Hon’ble High Court  in the reference 4th read above and the recognition given by the National Council for Teacher Education, Bengaluru, vide reference 1st read above, Government hereby permit Ayesha College of Education, Mallaram Village and City, Varni Road, Nizamabad Taluk & District,  to start B.Ed, Two Years Course,  with an Annual Intake  of 100 students (2 units), pending final orders of the NCTE on the Show Cause Notice dated.28.11.2017, issued to Ayesha College of Education and also pending final orders of the  Hon’ble High Court in Writ Appeal No.9/2018 in W.P.No.32813/2017 and Writ Appeal No.1995/2017 in W.P.No.33310/2017 filed by the Government in similarly situated cases.

10. The Commissioner and Director of School Education, Telangana, Hyderabad; the Secretary, Telangana State Council of Higher Education, Hyderabad; and the Registrar, Telangana University, Nizamabad District shall take further necessary action accordingly.
